Resumo: A Lei 10.639/03 depositou diante do universo docente o desafio de propalar o Ensino de História e Cultura Afro-brasileira e Africana, numa perspectiva contrária a visão eurocêntrica predominante até então. Cabia às Secretarias de Educação subsidiar as escolas, o que exigia formação de equipes aptas ao processo, bem como compreensão da lei e mudanças nas concepções de currículo e práxis dos/as educadores/as. O presente artigo vem apresentar justamente a caminhada da Secretaria Municipal de Educação no Município de Manaus/SEMED/MANAUS quanto (...) a inserção dos temas nas documentações. Apresenta a construção de uma Proposta Pedagógica Curricular/PPC, alinhada a lei. Contudo, traz a reflexão de que a mudança realizada na PPC é um avanço, mas não é garantia de disseminação de atitudes e conhecimentos necessários para a formação integral antirracista dos estudantes. A SEMED/MANAUS, reconhece que é necessário a mudança de postura dos educadores, por isso desde a implantação da referida PPC, realiza oficinas, formações e demais ações pertinentes a temática. Dessa forma conjectura-se que o trabalho dos/as professores tem caminhado na perspectiva da formação integral antirracista dos estudantes. Palavras chaves: Lei 10.639/03. Escola. Currículo. The theme of consent is, without question, associated with the origins of bioethics and is one of its most significant paradigms that has remained controversial to the present, as is confirmed by the proposal for its debate during the last World Congress of Bioethics. Seen broadly as a compulsory minimum procedure in the field of biomedical ethics, even today it keeps open the issues that it has raised from the start: whether it is really necessary and whether it can be (...) proven to be effective. My goal will be to attempt to determine the most genuine and relevant meaning of consent, going back from its present dominant normative meaning and, from there, identifying or simply sketching other possible forms of its expression in the world we live in, so as to justify its pertinence and validity. This objective will involve three stages: (1) ‘Consent’ as a privileged paradigm of bioethics (the ethical-juridical sense), (2) The symbolic value of ‘consent’ (the social-cultural sense), and (3) ‘Consent’ as promotion of the human (the humanistic-personal sense) .It is concluded that the common notion of normative consent is not the only one, nor does it hold universal validity; that, from a historical-cultural perspective, new expressions of consent appear, adapted to different social contexts and to possibly be implemented in developing countries; and, finally, that consent is strictly indispensable in situations of extreme dependence, in its symbolic relational character, in as much as it promotes ethical relationships among strangers and ensures that they remain so. The text analyses rituals as endeavours to preserve the identity of a people or a portion of a people. Rituals present or re-present the supposed common history of all the migrants. Social memory and history then tend to merge and to forget... forgetfulness is the driving force behind the writing of history. Particularly critical is the moment when the migration starts, because the need to adapt to new conditions as well as to maintain what is represented as their social identity (...) makes dual – and at times contradictory – demands on the migrants’ imagination. This article analyzes the issue of organizational transparency through the lens of Thomas Aquinas’ ethics. It provides moral justification for current claims about corporate transparency and sheds light on the ethical values and virtues affecting information disclosure decisions. Transparency is conceptualized as an informational mechanism necessary for performing the virtues of truthfulness, justice, and prudence. This article extends the organizational transparency and corporate social responsibility literatures by providing an alternative moral justification grounded in virtue-based theory, which extends our understanding of (...) the information disclosure decisions made by management. In this essay, I propose a comprehension of the meaning of politics based on Martin Heidegger’s thinking. I will develop the idea of the political as essential displacement of humanity. This notion will be achieved precisely by understanding the Heideggerian interpretation of Polis [πόλις] as the historical place i.e. the “site of history” [Geschichtesstätte]. In order to establish my argument, I will focus not only on explicit references to the concept of Polis in his literature, but also on a brief (...) analysis of two key concepts presented in his work in the late 1930s: machination [Machenschaft] and lived-experience [Er-lebnis]. It is through these concepts, but also how, through them, a technicity and history are related, that I will delineate a context for the meaning of politics as essential displacement of humanity, which will thereby conform to the basic character of the techno-political being. Nevertheless, a reflection upon the meaning of politics leading to the characterisation of the human as a techno-political being will show itself as the question about the place of the philosopher, a way to put philosophy itself in question. A segunda parte desse texto consiste na tradução e notas à traduçãoda referida carta de Janeiro de 1790.

Civil disobedience is a form of protest consisting in an act contrary to law, whose aim is to bring about a change in laws or policies deemed unjust. In the traditional Western philosophical debate, civil disobedience was mainly discussed and justified within the boundaries of a democratic regime. John Rawls’ theory of civil disobedience is explicitly based on this liberal assumption. He conceptualises civil disobedience as a public, nonviolent, conscientious and political breach of the law, only appropriate to nearly just (...) societies, hence to democratic regimes. This article intends to question Rawls’ premise by considering civil disobedience from a different perspective: when it is undertaken outside of a nearly just framework, precisely in not fully democratic contexts, such as the so-called “anocracies”, regimes that mix democratic and autocratic traits. The emblematic case of Sudan’s most recent actions of civil disobedience is examined to argue that, contrary to the liberal conceptualisation, civil disobedience does have a role and appropriateness in frameworks of this kind, where the aim is not only to oppose unjust laws or policies, but also to achieve a broader structural change through rigorously nonviolent forms of political action. A common account sees the human genome sequencing project of the 1990s as a “natural outgrowth” of the deciphering of the double helical structure of DNA in the 1950s. The essay aims to complicate this neat narrative by putting the spotlight on the field of human chromosome research that flourished at the same time as molecular biology. It suggests that we need to consider both endeavors – the human cytogeneticists who collected samples and looked down the microscope and the molecular (...) biologists who probed the molecular mechanisms of gene function – to understand the rise of the human genome sequencing project and the current genomic practices. In particular, it proposes that what has often been described as the “molecularization” of cytogenetics could equally well be viewed as the turn of molecular biologists to human and medical genetics – a field long occupied by cytogeneticists. These considerations also have implications for the archives that are constructed for future historians and policy makers. (shrink)

In semiotics, final causation can be related to the process of determination (PAPE, 1993). From Peirce’s point of view, determination is not a causal determinism, but a delimitation of a range of possibilities. One starts from objects towards interpretants, in a process mediated by the sign, in which the dynamic object works as a force that constrains interpretants to correspond to their objects. The correspondence between object and interpretant is important because it is through a generated interpretant that the object (...) of a sign can be known. Even though this process of determination coincides with the idea of final causation, there is a certain indeterminacy in it. For Peirce (EP 2:353, 1905), vagueness and generality are two types of indeterminacy. In the terms of the phenomenological categories, vagueness is an indeterminacy of the order of firstness, generality an indeterminacy of the order of thirdness, and both, to some extent, are opposed to that which is defined, which belongs to secondness. Each aspect of the sign may vary according to the three phenomenological categories. Consequently, degrees of imprecision are added to the semiotic process, which is a determination process. Peirce asserts that the perfect precision of thought is theoretically unattainable (SS 11, 1903). Every sign is vague or general at least to some degree. In this paper, we seek to perceive degrees of indetermination and causality from an analysis of the kinds of objects and interpretants proposed by Peirce in the system of 28 sign classes. (shrink)

Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

For many years, scientific heritage has received attention from multiple actors from different spheres of activity—archives, museums, scientific institutions. Beyond the heterogeneity revealed when examining the place of scientific heritage in different places, an authentic patrimonial configuration emerges and takes the form of a nebula of claims and of accomplishments that result, in some cases, in institutional and political recognition at the national level, in various country all around the world. At the international level, the creation of the international committee (...) dedicated to University Museums and Collections within the International Council of Museums certainly testified from this raising interest in academic heritage and the existence of a specific community concern with it.This article presents numerous initiatives for the preservation of scientific heritage in France, with the goal of analysing the relationship scientists have with their heritage. We argue that scientific communities have a special relationship with heritage, which is characterized by a number of ambiguities. We show that such ambivalences allow analysis of identity, discipline, professional, and social issues operative in defining heritage and being redefined by heritage. To explore these dimensions, we have chosen to present three different case studies. The first traces the institutional uses of heritage by a scientific institution, the Commissariat à l’énergie atomique, through the transformation of the first French atomic reactor into a museum. The second example describes the initiatives of French astronomers from the mid-1990s to construct a national programme for the protection of astronomy heritage. Lastly, we recount the case of universities, with the example of the Université de Strasbourg. (shrink)

The susceptibility of Habermas' socio-political theory (and notion of constitutional patriotism) to the charge of motivational impotence can be traced to a problem in the way in which he conceives of discursive practical reason. By implicitly constructing the notion of discursive rationality in contrast to, and in abstraction from, the rhetorical and affective components of language use, Habermas' notion of discursive practical reason ends up reiterating the same binaries — between reason and passion, abstract and concrete, universal and particular — (...) that provide the tacit parameters used by his critics to motivate the charge of impotence. Habermas' project of reconciling social integration and political rule with freedom can succeed only by rebuilding his discourse-ethical theory of politics upon a notion of discursive practical reason that overcomes these philosophy/rhetoric binaries common to both camps. The article deals with „The Symbolic Force of Human Rights“. Firstly, it restricts the meaning of the term „symbolic“ and of the expression „symbolic force“. Secondly, it discusses two matters: (1) a semantic matter, concerning the meaning of human rights; and (2) a pragmatic matter, related to utterance of human rights’ holders. The article emphasizes that it is not about „eternal“ rights, but rather a legal-political construction and conquest of modernity. Based on such assumptions, the author goes to the core (...) of his argument, characterizing the symbolic force of human rights as ambivalent: on one hand, it serves for the generalized affirmation and accomplishment of rights related to legal inclusion in conditions of structural dissension; on the other hand, it acts as a manner of political manipulation, whether to conceal circumstances involving lack of rights or, more abruptly, to give cause to political oppression. In this regard, the article focuses, firstly, on the symbolic force of human rights at the level of National States, and then within the international and worldwide context. Finally, the author states a brief critique concerning the rhetorical use of human rights by the nowadays’ unique superpower, the United States of America. (shrink)

This article sets out to move from questioning the autonomy of law from the external standpoint of sociology to problematizing it from the internal legal standpoint. The first step is an analysis of the Kelsenian theoretical model of the hierarchically structured self-production of law, taking into consideration the concept of reason for the validity of a norm and of a legal order, as well as the role of efficacy as a condition for validity. The second is a presentation of Luhmann’s (...) conception of autopoiesis of the legal system, and in particular the function of the Constitution in the operative closure of law. Based on this exposition, the discussion then focuses on the limits of both conceptions, but in reverse order: first questioning the possibility of transporting the concept of autopoiesis to the different conditions for reproduction of law in contemporary world society, and then raising objections to the adequacy of the concept of hierarchically structured self-production of law to the many different legal orders in today’s world. The conclusion drawn from these critical observations is the argument that the Luhmannian sociological theory of the operative self-reference of the legal system and the Kelsenian legal theory of the self-produced step-structure of law are applicable only to legal systems minimally grounded in the rule of law. This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

This article discusses how the persistence of child labor, especially in Brazil and the United States of America, constitutes a current facet of neo-colonialism. Cultivated as an educational and dignifying activity, exploited child labor persists and is naturalized. Schools, religions, and the legislation contribute to making the working class come to love and naturalize what in the past was understood as torture and punishment, thus jointly acting as a fundamental means of forming a new cultural form: the love of work. (...) Initially, the article discusses how the culture of work is historically founded and then argues against the idealist and postmodern explanations that naturalize it. The argument is based on the understanding that culture has a material basis and is linked to the production and social reproduction of life. Data from the empirical research on child labor in tobacco farming in Brazil and the USA reveal the persistence of the problem among Latino children and families. We conclude with the need to found a new culture for contemporary society, based on other social and economic relations, which allows the working class to free itself from what dominates and exploits it. Cette étude analyse comment Kelsen, pour libérer le droit et la démocratie des traces de ce qu'il appelle les hypostases collectives ou la mythologie de l'âme collective, prend position face aux grandes théories de la sociologie et de la psychologie sociale de son temps. D'abord, il s'agira de montrer comment Kelsen critique les métaphores de l'âme collective ; ensuite, de montrer comment la pensée kelsénienne sur le droit et la démocratie essaie d'échapper aux problèmes liés à la métaphore de l'âme (...) collective. Cela peut laisser entrevoir quelques points communs entre la théorie de Kelsen et les théories contemporaines sur le droit et la démocratie libérées des prémisses de l'idée d'une communauté homogène. The aim of this essay is to analyse how Kelsen criticises the major theories of sociology and social psychology of his time in order to liberate law and democracy from what he calls collective hypostasis or the mythology of the "collective soul". The first part investigates how Kelsen criticises the metaphors of the collective soul. The second part addresses how Kelsen built a theory of law and democracy that sought to escape from problems correlated to the metaphors of the collective soul. The results enable the reader to glimpse some common points between Kelsen's ideas and contemporary projects to elaborate a theory of law and democracy released from the premises implicated by the idea of a uniform community. BackgroundAlthough a large number of clinical trials on interventions demonstrating efficacy (or lack thereof) are conducted annually, much of this evidence is not accessible to scientists and clinicians.ObjectivesWe aimed to determine the publication rate of posttraumatic stress disorder (PTSD) trials that have been registered in clinical trial registries, and the factors associated with publication.MethodsTrials, completed on January 15, 2015, were identified via the US National Institutes of Health clinical trials registry, the European Union Clinical Trials Register and the WHO International (...) Clinical Trials Registry Platform. A systematic search for publications (published by the end of March 2018) related to each of the registered trials were then performed.ResultsFour hundred and thirty-eight of 1982 potentially eligible trials were included. Only 34% of interventional trials were registered prior to initiation, 9% were registered within 2 months of starting and 20% after trial completion. Of the 438 included trials, 72% had generated peer-reviewed publications, while an additional 7% had disseminated results in some other form (such as on the trial database), 26 months after trial completion. Randomisation of a trial was the only factor individually associated with publication, in logistic regression analysis (p < 0.001). Intervention type, university as sponsor and study registration prior to completion were factors that influenced the time to publication, using Cox regression (p < 0.001).ConclusionsThis study underscores the importance of timely and accurate publication and dissemination of trial results, in order to avoid the potential waste of resources and to ensure research integrity and patient safety. We suggest that authors and journal editors adhere to conditions set out by the International Committee of Medical Journal Editors and that more diligent data sharing is encouraged through prospective trial registration and trial reporting websites.
